These Terms of Service ("Terms") govern your access to and use of the Masterclass Languages website, app, and services (the "Service"), provided by Masterclass Languages ("we", "us", "our"). By using the Service you agree to these Terms.

1. Who you are contracting with

You are entering into these Terms with Masterclass Languages. You must be old enough to form a binding contract in your jurisdiction, or have your parent or guardian's consent.

2. The Service

Masterclass Languages provides AI-powered language lessons and access to human tutors. Features and content may change over time as we improve the Service.

3. Your account

You are responsible for keeping your account credentials confidential and for all activity under your account. You must provide accurate information and keep it up to date.

4. Acceptable use

You agree not to:

• use the Service unlawfully, fraudulently, or to send spam;
• infringe the intellectual property or other rights of anyone;
• upload malware, probe or scan the Service, scrape it, or otherwise interfere with its security or availability;
• harass, threaten, or abuse other users or our tutors.

5. Intellectual property

The Service, including its software, content, lesson materials, and branding, is owned by Masterclass Languages or its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service in accordance with these Terms and your chosen plan. You may not reverse engineer, resell, redistribute, or circumvent technical limits.

6. Payments and subscriptions

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, cancellation, and refund mechanics are governed by the Paddle Checkout Buyer Terms.

Subscriptions renew automatically at the end of each billing period until you cancel. You can cancel at any time; access continues until the end of the paid period. See our Refund Policy.

7. Service level

We work hard to keep the Service running, but we do not guarantee that it will be uninterrupted or error-free. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

8. Suspension and termination

We may suspend or terminate your access if you materially breach these Terms, fail to pay, create a security or fraud risk, or repeatedly or seriously violate our policies. You may stop using the Service at any time.

9. Liability

To the fullest extent permitted by law, our aggregate liability arising out of or related to the Service is limited to the fees you paid us in the 12 months before the event giving rise to the claim. We are not liable for indirect, consequential, or special damages including loss of profits, data, or goodwill. Nothing in these Terms limits liability that cannot be limited by law.

10. Indemnity

You will indemnify us against claims arising from your unlawful use of the Service, your content, or your violation of these Terms.

11. Changes

We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance.

12. Governing law

These Terms are governed by the laws applicable at the seat of Masterclass Languages, without regard to conflict of laws rules.
